What are the pool barrier rules in Miami-Dade?
Miami-Dade County's Swimming Pool Permits page requires all new pools, spas and hot tubs to have a permanent barrier whose top is at least 48 inches above grade on the side facing away from the pool. Chain link or non wind resistant fences used as a residential pool barrier need a building permit. The City of Miami issues its own building permits, so confirm with the City for property inside city limits.
Do I need a City of Miami permit to replace pool equipment or add a hot tub?
Often not. City of Miami Code Sec. 10-5 exempts repair or replacement of residential pool equipment, other than a pool heater, from permits when a licensed plumbing contractor does the work. Above ground prefabricated whirlpool tubs are also on the exempt list. Pool heaters and new construction still need permits, so confirm with the City's Building Department before starting.
