What are the pool fence rules in Whitby?
Whitby's Fence By-law 8228-25 requires a pool enclosure permit before building a private outdoor pool and counts ornamental ponds as pools if water can exceed 0.6 m deep. The enclosure must be at least 1.2 m high, non climbable and free of unprotected openings over 100 mm; gates must be self closing and self latching and padlocked when the pool is not in use. That 1.2 m minimum is lower than neighbouring Oshawa and Ajax, so confirm Whitby's rules with the Town.
Do above ground pools and hot tubs need a fence in Whitby?
Under By-law 8228-25, an above ground pool's wall plus any guard may form the enclosure if it totals 1.2 m to 2.6 m above grade and ladders are removable or lockable. Hot tubs, whirlpools and spas are exempt if they have a secure locking cover kept locked when not in use. Check with the Town that your setup qualifies.
When can I fill a new pool in Whitby?
Water may not be put in a new pool until the enclosure is complete and signed off by a Municipal Law Enforcement Officer under By-law 8228-25. Lots in the Central Lake Ontario Conservation Authority screening area also need its approval. Plan both before scheduling the first fill.
Can you inspect a hot tub or spa at the same time?
Yes. Spas and hot tubs can be inspected alongside the pool or on their own, which is useful when a property has both.
